These Terms of Use govern your use of AboveSpot. By using the site, you agree to them. If you do not agree, please do not use AboveSpot.

AboveSpot is a business of Talaro Pty Ltd (ABN 56 701 866 275). In these Terms, "we", "us" and "our" mean Talaro Pty Ltd.

What AboveSpot is

AboveSpot is an independent analytics and information service covering precious-metal bullion in Australia. We collect, analyse and publish information about bullion prices, premiums and related market data.

We do not sell bullion. We are not a dealer, a broker or a financial adviser. Everything here is general information only, and it is not financial, investment or purchasing advice.

Information and data

We work to keep the information here useful, accurate and current. Bullion prices, dealer premiums and product availability can change quickly, so some of what you see may be out of date by the time you read it.

The site and its data are provided on an "as is" and "as available" basis. We do not guarantee that the information is accurate, complete, current or error-free, or that the site will be available or uninterrupted.

Our Methodology explains how the data is collected and calculated, and the Disclaimer sets out its limits.

Before you buy anything, confirm the price, product details, availability, shipping and the dealer's own terms directly with that dealer.

Acceptable use

You may use AboveSpot for any lawful purpose, subject to the limits in this section and in "Our content" and "Using our data" below.

You must not:

• attempt to disrupt, damage or overload the site or its infrastructure;
• attempt to gain unauthorised access to the site, its systems or its data;
• access the site with automated tools that ignore our robots.txt, hide who is running them, or put a heavy load on the site;
• harvest, bulk-copy or systematically reproduce our data; or
• use AboveSpot for any unlawful or fraudulent purpose.

If we reasonably believe the site is being misused or these Terms are being breached, we may restrict or suspend access. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.

Our content

The AboveSpot name and branding, this website, its software and design, our written methodology and the text on these pages are ours or licensed to us, and are protected by copyright and other intellectual-property law.

You may view, link to and share our content for personal, non-commercial purposes, as long as you do not alter it or misrepresent where it came from.

The underlying facts we work with, such as a price a dealer advertises publicly, are not ours. We do not claim them and we are not asserting ownership of the numbers themselves.

Using our data

AboveSpot is designed for people to use the information on the site, not to provide a free copy of the underlying dataset.

You may view and use information displayed on AboveSpot for your own research and decision-making. You may not systematically extract, reproduce, redistribute, resell or commercially exploit our collected dataset, our derived premiums or any index we may publish without our written permission.

This restriction is about the dataset as a whole and the work involved in collecting, processing and maintaining it. We gather information from dealers' public pages, identify ourselves, collect it at regular intervals and send users back to the dealer's own site to buy.

We do not want that work to become a shortcut for reproducing or republishing the same dataset elsewhere without our permission.

If you want to use our data beyond normal use of the site, ask us. We are open to discussing reasonable uses, particularly for research.

Links to other websites

We link to dealer websites so you can see a product directly. We do not control those sites and we are not responsible for their content, prices, availability, terms, privacy practices or transactions. Anything you buy from a dealer is between you and that dealer.

We earn no commission on these links. AboveSpot makes no money when you click through or buy. If that ever changes, we will say so clearly on the page, and it will not affect how products are ordered or which dealers are included.

Accounts and paid features

Some features may later need an account or a paid subscription. If that happens, the additional terms, the price and the conditions will be shown to you before you subscribe or pay, and they will apply on top of these Terms.

Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law, where that cannot lawfully be excluded, restricted or modified. If you are a consumer under the Australian Consumer Law, you keep those rights whatever else these Terms say.

Subject to that, and to the maximum extent the law allows, we are not liable for any loss, damage, cost or expense arising from your use of, or reliance on, AboveSpot or the information on it. That includes loss arising from errors, omissions, delays, interruptions, missing information, changes in dealer pricing or availability, or reliance on information that is no longer current.

Where our liability can be limited rather than excluded, it is limited to resupplying the information or the reasonable cost of having it resupplied.

Changes to AboveSpot and to these Terms

We may change, suspend or discontinue any part of AboveSpot at any time.

We may also update these Terms. When we do, we will publish the new version here and change the "Last updated" date. If a change materially affects your rights, we will take reasonable steps to bring it to your attention before it takes effect, such as a notice on the site.

Changes apply from the date they are published and do not apply retrospectively. If you do not agree to a change, you can stop using AboveSpot.

If part of these Terms does not apply

If any part of these Terms is found to be unenforceable, that part is severed and the rest continues to apply.

Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and of the courts able to hear appeals from them. Nothing here prevents you from bringing a claim in another place where the law gives you that right.
